The National Pharmaceutical Pricing Authority (NPPA) has issued a new directive clarifying the requirements under the Drugs (Prices Control) Order (DPCO), 2013. The government has clarified that the phrase “on a conspicuous part of the premises where he carries on business” in Para 24(4) and 25(3) of the DPCO encompasses both physical and virtual/online/electronic premises. This means that online pharmacies operating through websites, portals, mobile apps, e-commerce platforms, or any other online mode are equally obligated to display the current price list as brick-and-mortar stores.
Para 24(3) of the DPCO, 2013, requires manufacturers to issue price lists (Form-V or Form-VI) to dealers, State Drugs Controllers, and the government, indicating any price fixation or revision. Para 24(4) and 25(3) then mandate that every retailer and dealer, including online pharmacies, display these price lists and supplementary lists in a conspicuous and easily accessible manner.
This requirement ensures that consumers can access accurate and consistent pricing information, regardless of the sales channel they choose. NPPA has ordered that the displayed prices should match the latest price list issued by drug manufacturers or marketers.
Failure to comply with Para 24 and 25 of the DPCO, 2013, is punishable under DPCO and the Essential Commodities Act, 1955.
All retailers and dealers, including online pharmacies, are directed to ensure full compliance with the DPCO’s price display requirements.
